SAFEDOX SERVICES AGREEMENT
THIS SAFEDOX SERVICES AGREEMENT (together with all Appendixes and Attachments, this “Agreement”) is made as of the date of acceptance of these terms and conditions (the “Effective Date”), by and between [SAFEDOX] (“SafeDox”) and you (“You” or “Customer”). Each of SafeDox and Customer may be referred to as a “Party”, and collectively the “Parties”. By clicking “I Agree” or any similar button, Customer represents and warrants that Customer has the authority to enter into this Agreement and that Customer has read, understood, and agrees to be bound by the terms and conditions contained herein.
1. Acceptance of Terms
By using the SafeDox services, you agree to the following Terms and Conditions.

2. Services Provided
SafeDox offers document storage and management services, including physical document storage, digital scanning, and retrieval services. Upon acceptance of this Agreement by your submission below, You may submit one contract of up to 250 pages to SafeDox for secure storage. SafeDox will maintain space for your documents within a suitable environment in SafeDox’s facilities from which SafeDox will be able to satisfy its obligations under this Agreement.
3. Customer Responsibilities
Customers is responsible for ensuring that documents stored with SafeDox do not contain illegal content or violate any laws.
4. Fees and Payment
Storage fees are billed annually, and will automatically renew on the anniversary of the Effective Date of the Agreement, unless you cancel on 30 days’ prior written notice. Payment shall be made via credit card. You acknowledge and agree that SafeDox may increase the fees for the storage of documents each year by as much as 5% in its sole discretion.
Late payments may incur additional fees.

5. Access to Documents
Only You or any individual identified by You in writing may request access to the documents stored with SafeDox.
6. Document Return and Amendment
Customers are entitled to have their documents returned one time during the term of this agreement. Each additional request will be charged a fee of $50. Upon return of such documents to secure storage with SafeDox, You will be billed a fee of $50. Any amendments to the physical contract will be subject to a filing fee of $50. There will be no fee for digital amendments.
7. Term and Renewal
This agreement will automatically renew each year unless terminated by You upon 30 days' written notice.
If this Agreement is terminated by You, documents will be returned to You at your intake form address for a fee of $50.
8. Liability
SafeDox’s liability for any claims arising out of this agreement shall be limited to the total amount of fees received from You in the twelve (12) months preceding the event giving rise to the claim.
SafeDox shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, arising out of or in connection with this agreement.
9. Class Action Waiver
You agree that any dispute, claim, or controversy arising out of or relating to this Agreement or our services shall be resolved on an individual basis, and you waive any right to pursue any claim as a class action, representative action, or through any other similar proceeding. This waiver applies to any claims whether arising in law or in equity.
10. Arbitration
Any dispute arising out of or related to this Agreement or the services provided by SafeDox shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Atlanta, Georgia, and the decision of the arbitrator(s) shall be final and binding.
11. Privacy and Data Protection

12. Changes to Terms
SafeDox reserves the right to update terms of service at any time in its sole discretion upon 30 days' notice.
13. Governing Law
This Agreement shall be governed by the laws of the State of Georgia.

15. Non-Custodial Status. SafeDox’s performance of services shall not cause SafeDox to be deemed a “custodian” of the records or Customer’s “designee” under state or federal law with respect to such records.
